Benjamin Delo, the co-founder of the cryptocurrency exchange BitMEX, was sentenced to 30 months probation for violating the Bank Secrecy Act (BSA), which is a law against money laundering.

The sentence, handed down in a federal court in New York on June 15, follows his plead guilty to charges in February of “willfully failing to establish, implement and maintain an Anti-Money Laundering (AML) program” in his role at BitMEX.

Prosecutors have argued Delo should serve one year in prison or receive at least a two-year probationary period along with six months of house arrest, as given to former CEO Arthur Hayes in May.

For Delo, his lesser sentence includes the lawsuit that started in October 2020 who also saw co-founders There is and Samuel Reed along with BitMEX’s first official employee Gregory (Greg) Dwyer charged with similar transgressions.

Judge John Koeltl called Delo’s violations “very serious” and said he knew BitMEX was violating U.S. laws by not implementing an AML and knowing your client (KYC) system.

However, Judge Koeltl noted that the exchange later took steps to correct the issue and is met.

“Looking back, I see a fundamental failure to address a flaw in our systems,” Delo told the court, adding that he deeply regrets the actions that have brought him into contact with the legal system and promised that it would be his last brush with Item.

Judge Koeltl, a United Kingdom citizen living in Hong Kong, ordered that Delo be allowed to serve his probation in Hong Kong.

Judge Koeltl also took into account the fact that Delo paid a fine of $ 10 million the completion of a court order from May in a civil case brought by the Commodity Futures Trading Commission (CFTC) for breach of aspects of the Commodity Exchange Act.

A spokesman for Delo’s legal team said after the sentencing that they were glad the court rejected “the government’s cynical attempt to exaggerate the seriousness of the Bank Secrecy Act charge in this case.”

Delo’s lawyers said he plans to leave the US for Hong Kong soon.

Meanwhile, Australian-born former BitMEX head of business development, Greg Dwyer, who currently lives in Bermua, is in talks with the federal court in New York to extend a deadline for submitting pre-trial documentation. accordingly to the Sydney Morning Herald.

A letter sent to the court by Dwyer’s lawyer said “the parties continue to discuss a possible solution to the case.”
